These Terms & Conditions (“Terms”) are a binding agreement between you and The Civil Dog, operated by Ball & Bone LLC (“The Civil Dog,” “we,” “us,” or “our”). By accessing or using thecivildog.com, submitting an online form, creating an account, requesting an appointment, purchasing through our website, or otherwise using an online service that links to these Terms, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the website or submit information through it. Additional written agreements may apply to consultations, assessments, dog training, coaching, memberships, classes, boarding/residency, live-in/concierge services, transportation, or other services. If a signed service agreement conflicts with these Terms regarding the specific service covered by that agreement, the signed service agreement controls to the extent of the conflict.

1. Eligibility and Authority

You must be at least 18 years old and legally capable of entering into a binding agreement to purchase services or submit a service request. If you act for another person, household, organization, or dog owner, you represent that you have authority to do so and to provide the information you submit.

2. Website Information Is General Information

Website content is provided for general educational and informational purposes. Dog behavior and training outcomes depend on many factors, including the dog, environment, health, history, handling, consistency, household participation, and events outside our control. Website content is not veterinary, medical, legal, or other licensed professional advice, and it is not a substitute for an individualized evaluation.

Descriptions of services, program structures, availability, pricing, eligibility standards, expected timelines, and results may change. A website description does not guarantee that a particular service is appropriate for you or your dog, that we will accept a service request, or that a particular outcome will occur.

3. Service Requests, Consultations, and Acceptance

Submitting an intake form, consultation request, calendar request, or other inquiry does not create a trainer-client relationship and does not obligate The Civil Dog to accept an appointment or provide services. Requests may require review and confirmation. A booking is confirmed only when we communicate acceptance and any required payment, deposit, or service agreement has been completed.

We may decline or discontinue a requested service when permitted by law, including for safety, service-area, scheduling, capacity, suitability, inaccurate information, nonpayment, abusive conduct, or inability to meet the dog’s or household’s needs.

4. Accuracy of Information

You agree to provide complete and accurate information that is reasonably relevant to safety and service delivery, including material behavior history, bite or aggression history, health or medication information, and contact information when requested in connection with services. You are responsible for updating material information that changes. Knowingly withholding material safety information may affect our ability to provide services and may constitute a breach of an applicable service agreement.

5. Prices, Payments, Deposits, Refunds, and Cancellations

Prices and availability displayed online may change before a booking is accepted. Taxes, travel charges, processing charges, deposits, or other disclosed fees may apply. Payment terms, cancellation rules, refund eligibility, credits, expirations, rescheduling, no-shows, and program-specific financial terms are governed by the offer presented at purchase and any applicable service agreement.

Nothing in these Terms waives a cancellation, refund, or other consumer right that cannot lawfully be waived. Certain transactions conducted away from a fixed business location may carry statutory cancellation rights depending on the circumstances and applicable law.We may send service-related emails when reasonably necessary to provide requested services or respond to you. Where permitted, we may also send promotional emails. Marketing emails will provide a method to unsubscribe. Unsubscribing from marketing does not prevent us from sending non-promotional communications that are necessary to administer an active transaction, appointment, account, or service relationship.

6. Electronic Records and Signatures

You agree that transactions with us may be conducted electronically and that electronic records, acknowledgments, checkbox acceptances, and electronic signatures may be used to evidence agreements and consents to the extent permitted by law. You may retain a copy of these Terms and any electronic agreement for your records. Where law requires a separate consumer consent or disclosure for electronic delivery, that separate requirement will control.Our website may use cookies, pixels, tags, local storage, and similar technologies. Some are necessary for website operation and security. Others may help us understand traffic, measure conversions, remember preferences, or evaluate advertising. Browser settings and certain platform controls may allow you to block or delete cookies, although doing so can affect website functionality.

Where applicable law requires consent for non-essential technologies, we will use them subject to the consent choices presented to you. We do not represent that browser-based “Do Not Track” signals are universally recognized. Where a legally recognized opt-out preference signal applies to us, we will respond as required by applicable law.

The Civil Dog may offer separate optional text-message programs. The consent choices shown at the point of collection determine the categories of messages you authorize.

Non-marketing messages

If you opt in to non-marketing text messages, you may receive messages from The Civil Dog concerning inquiries, consultation or appointment requests, confirmations, reminders, scheduling, service updates, account or client-support communications, and other messages related to a transaction or service you requested.

Marketing messages

If you separately opt in to marketing text messages, you may receive promotional messages from The Civil Dog about services, programs, events, offers, educational content, and business updates.

8. Email Communications

You may receive service-related email communications when reasonably necessary to respond to you or administer a requested or active service. Promotional emails will include an available unsubscribe mechanism as required by applicable law. You remain responsible for monitoring service-related communications concerning appointments, payments, safety, or active services.

9. Accounts, Portals, and Community Features

If we provide an account, client portal, course, membership, community, or other restricted-access feature, you are responsible for maintaining the confidentiality of your credentials and for activity under your account. You may not share access in a way that defeats paid access limits, copy restricted materials for redistribution, scrape content, interfere with platform security, impersonate another person, or use the feature unlawfully.

We may moderate or remove content and may suspend access for material violations of these Terms or applicable program rules, subject to any rights in a separate service agreement.

10. Intellectual Property

The website and its original content, including The Civil Dog name, branding, logos, graphics, photographs, videos, written materials, training frameworks, scoring systems, educational materials, course content, downloads, and arrangement of content, are owned by or licensed to The Civil Dog and are protected by applicable intellectual-property laws.

We grant you a limited, revocable, non-exclusive, non-transferable license to access website content for your personal, non-commercial use. Unless we give written permission, you may not reproduce, publish, distribute, sell, license, create derivative commercial materials from, or systematically extract our protected content. Nothing in these Terms transfers ownership of our intellectual property.

11. User Content, Reviews, Photos, and Submissions

You retain ownership of content you submit to us. By voluntarily posting content to a public-facing feature we operate, you grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, display, and distribute that content as reasonably necessary to operate that feature.

Private client photos, videos, testimonials, names, or likenesses will not be treated as a blanket marketing release merely because you sent them to us. Any marketing or publicity use that requires permission will be governed by the consent or media release presented to you. You represent that content you submit does not infringe another person’s rights or violate law.

12. Acceptable Use

You may not use our website or systems to violate law; transmit malware; probe or defeat security; interfere with operation; harvest personal information; send unauthorized advertising; impersonate others; infringe intellectual-property or privacy rights; submit fraudulent information; or engage in threatening, harassing, abusive, or dangerous conduct. We may restrict access when reasonably necessary to protect people, animals, systems, or legal rights.

13. Third-Party Services and Links

Our website may integrate with or link to third-party services such as scheduling, payment, mapping, communications, social-media, analytics, or other platforms. We do not control those third parties and are not responsible for their independent content, availability, security, terms, or privacy practices. Your use of a third-party service may be subject to its own terms.

14. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE AND GENERAL ONLINE CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM IMPLIED WARRANTIES RELATING TO THE WEBSITE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE EXTENT THOSE WARRANTIES MAY LAWFULLY BE DISCLAIMED.

WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE, OR THAT GENERAL EDUCATIONAL CONTENT WILL PRODUCE A PARTICULAR TRAINING OR BEHAVIORAL RESULT. WARRANTIES OR COMMITMENTS EXPRESSLY STATED IN A SIGNED SERVICE AGREEMENT ARE NOT DISCLAIMED BY THIS SECTION.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE CIVIL DOG AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING SOLELY FROM USE OF, OR INABILITY TO USE, THE WEBSITE OR GENERAL ONLINE CONTENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY ARISING SOLELY FROM THE WEBSITE OR GENERAL ONLINE CONTENT WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US THROUGH THE WEBSITE FOR THE TRANSACTION GIVING RISE TO THE CLAIM DURING THE SIX MONTHS BEFORE THE EVENT OR (B) $100.

This website limitation does not replace the allocation of risk, releases, liability terms, insurance provisions, or remedies contained in a signed service agreement. It also does not exclude liability that cannot lawfully be excluded or limited.

16. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless The Civil Dog and its owners, officers, employees, contractors, and agents from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful use of the website, your material breach of these Terms, or content you submit that violates another person’s rights. This section does not require you to indemnify us for our own negligence or misconduct where such indemnification is prohibited by law.

17. Privacy

Our Privacy Policy explains how we collect, use, disclose, retain, and protect personal information and is incorporated into these Terms by reference. If a specific consent disclosure conflicts with a general statement in these Terms, the more specific consent disclosure controls for that consent.

18. Governing Law and Disputes

Except where mandatory consumer law requires otherwise, these Terms and disputes arising from the website or these Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Subject to any mandatory law or a different dispute provision in a signed service agreement, the state and federal courts with jurisdiction over Grady County, Georgia will have exclusive jurisdiction over disputes arising solely from these Terms, and you consent to personal jurisdiction there.

Before filing a lawsuit concerning these Terms, the parties agree to make a good-faith effort to resolve the dispute informally by written notice describing the issue and requested resolution, unless immediate injunctive relief is reasonably necessary or law prevents such a requirement.

19. Florida and Other Mandatory Consumer Rights

If you purchase services in Florida or another jurisdiction that provides non-waivable consumer protections, those protections remain in effect. Nothing in these Terms is intended to waive a statutory right that cannot legally be waived. In particular, some qualifying Florida home-solicitation transactions may carry a three-business-day cancellation right and related written-contract requirements; whether those rules apply depends on how and where the transaction is solicited and completed.

20. Changes to These Terms

We may update these Terms prospectively. The “Last Updated” date identifies the current version. Changes apply when posted or on a later stated effective date. Material changes will not retroactively rewrite a completed transaction or signed service agreement unless the parties lawfully agree otherwise.

21. Severability; Waiver; Assignment; Entire Agreement

If a provision of these Terms is found unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain effective. A failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our written consent; we may assign these Terms in connection with a lawful reorganization, sale, or transfer of the business. These Terms, together with the Privacy Policy and any applicable transaction-specific terms, are the complete agreement concerning the website and general online services, but do not supersede a signed service agreement governing dog-training or care services.
